These Terms of Service govern the use of www.bluss.be and all purchases made through the BLUSS online store.

By using our website or placing an order with BLUSS, you agree to these Terms of Service.

These Terms do not affect any mandatory rights you may have as a consumer under applicable law.

Unless otherwise indicated, prices include applicable VAT and other taxes.

BLUSS reserves the right to change prices at any time. However, the price applicable to your order will be the price displayed at the time the order is placed.

In the event of an obvious pricing or technical error, we reserve the right to correct the error and, where necessary, cancel the affected order. If payment has already been made, the relevant amount will be refunded.

5. PLACING AN ORDER

By placing an order through our website, you are making an offer to purchase the selected products.

Before submitting your order, you will have the opportunity to review and correct your order details.

An order is only considered accepted once BLUSS has confirmed it.

You will receive an order confirmation by email after successfully placing your order.

We reserve the right to refuse or cancel an order where there is a valid reason, including:

  • suspected fraud or misuse;
  • incorrect pricing caused by an obvious error;
  • products being unavailable;
  • incorrect or incomplete customer information;
  • payment not being successfully completed.

If we cancel an order after payment has been made, the relevant amount will be refunded.

Available payment methods are shown during checkout.

Payment must be completed before an order is processed unless otherwise explicitly stated.

Payments may be processed by third-party payment providers.

BLUSS does not necessarily receive or store your full payment card details.

By providing payment information, you confirm that you are authorised to use the chosen payment method.

7. DELIVERY

We ship orders using the shipping methods available during checkout.

Delivery times provided on our website are estimates unless a specific legally binding delivery date has been agreed.

We aim to process and dispatch orders within the timeframe stated in our Shipping Policy.

Delays may occur due to circumstances beyond our reasonable control, including carrier delays, public holidays, high order volumes or customs procedures.

Belgian distance-selling rules require customers to receive clear information about delivery conditions and costs before purchase.

8. RIGHT OF WITHDRAWAL AND RETURNS

Consumers in the European Union generally have a statutory right to withdraw from an online purchase within 14 calendar days after receiving the goods, subject to the conditions and exceptions provided by law.

9. REFUNDS

Where required by law, refunds will be made using the same payment method used for the original transaction unless another method has been expressly agreed.

Any processing times displayed by banks or payment providers are outside BLUSS's direct control.

10. LEGAL GUARANTEE

All new consumer goods sold by BLUSS are covered by the statutory legal guarantee against lack of conformity.

Under Belgian consumer law, consumers are generally entitled to a two-year legal guarantee for new consumer goods from the date of delivery. BLUSS may not exclude or reduce this mandatory legal protection.

A lack of conformity may exist, for example, where a product:

  • does not correspond to what was ordered;
  • does not have the characteristics that a consumer may reasonably expect;
  • is defective in a way covered by the legal guarantee.

All content available on the BLUSS website, including but not limited to:

  • the BLUSS name and branding;
  • logos;
  • photographs;
  • graphics;
  • designs;
  • text;
  • videos;
  • product designs;
  • website content;

is owned by BLUSS or used with permission and may be protected by copyright, trademark and other intellectual property rights.

You may not copy, reproduce, modify, distribute, publish or commercially exploit our content without prior written permission from BLUSS, except where permitted by law.

12. ACCEPTABLE USE OF THE WEBSITE

You may use our website only for lawful purposes.

You must not:

  • attempt to gain unauthorised access to our website or systems;

14. PROMOTIONS AND DISCOUNT CODES

Promotions, discount codes, giveaways or special offers may be subject to additional conditions.

Unless otherwise stated:

  • discount codes cannot be exchanged for cash;
  • discount codes may not be combined;
  • discounts apply only during the stated promotional period;
  • promotions may be limited to selected products or stock;
  • promotions are subject to availability.

BLUSS is responsible for its obligations under applicable Belgian and European consumer law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

To the extent permitted by law, BLUSS is not liable for losses resulting from:

  • failure to follow product or care instructions;
  • circumstances outside our reasonable control;

We do not exclude liability for intentional misconduct, fraud or any liability that cannot legally be excluded.

BLUSS will not be responsible for delays or failures caused by circumstances beyond our reasonable control.
